Joblet Terms of Use for Employers

By using Joblet, a service of The Plant Co. Ltd., you are agreeing to the following terms of use ("Joblet Terms of Use").

1 Applying to Post Jobs on the Joblet Network

Please note that we may reject any job listings at our sole discretion.

We are not responsible for any damages that might occur by rejecting job listings or required to explain the reasons for the action. We can reject any job listings when a company meets any of the following conditions:

  • Breaching any of the Joblet Terms of Use
  • Providing false or incorrect information, or incomplete applications for some or all sections
  • Previously been rejected from using the Joblet service
  • Company is not legally established or performing business which is against the law, our internal rules, or rules of governmental or industry groups with which the company belongs.
  • Business performed is against public order or morality, is a pyramid scheme, scam, chain referral or any other type of business that could be a detrimental to participants and others
  • Business activities fall within the Sex Industry Law (風俗営業等の規制および義務の適正化等に関する法律) or sex-related services
  • Related to antisocial activities, antisocial forces or such companies or organizations
  • A dating site, sexually explicit site or live-chatting site
  • An unlicensed business operating in a field which requires a license or governmental approval
  • Company is or may be using the service for a purpose other than hiring
  • Company has previously encountered trouble with applicants before or after hiring through Joblet
  • Trying to use the Joblet service to or by a way which may harm us, other companies, applicants or third parties
  • Disrupting the service in any way
  • Trying to apply the service under with false information in order to avoid any of the conditions previously stated
  • Any other cases in which we decide the listing is not appropriate

2 Prohibited Uses

1. You are prohibited to take any of the following actions: (a) infringing on another’s or our copyrights, trademarks, or any other intellectual properties, (b) infringing on another’s rights such as a third party’s or our properties, privacy and honor, (c) providing false information, (d) putting either us or a third party at a disadvantage, (e) being offensive to public order and morals, (f) breaking laws or taking actions witch may break the laws, ordinances, rules, regulations, orders or other requirements of any governmental authority that has jurisdiction over you, (g) using the Joblet service for the purpose of selling or providing information for business purposes, (h) copying, selling or publishing information you obtained through the Joblet, or using information for anything beyond the private use, (i) disrupting operation of the Joblet service or actions which may cause this, (j) providing any applicant’s private information to third parties without applicant’s permission, or (k) any other actions we deem to be improper.

2. We can delete all or part of your information from the Joblet service without notice if we determine your sending of information falls under or may fall under any conditions stated in the previous terms. We are not responsible for any damages you might incur from this action.

3 Listing of Jobs

1. When you wish to post a job advertisement, you shall send it to us from the Joblet service by a means we specify, and we start any postings from a time which we designate.

2. Companies can stop a posted job listing at anytime by the specified means.

3. You can only post your company’s jobs. You can’t post jobs of more than one corporation nor more than one kind of job within one posting.

4. You must specify qualifications for applying a job by a means designated by us. You can’t, however, state discriminative expressions based on race, sex, religion, nationality, disability and age or qualifications which infringe Employment Promotion Law (雇用対策法), Labor Standard Act (労働基準法) or any other ordinances.

5. We can reject posting of any job listing when the job listing is or may be relevant to any of the following: (a) infringes on our, other companies’, applicants’ or third parties’ intellectual properties, portrait rights, privacy rights, honor, other rights or properties, (b) copying, changing, displaying or other actions we take which infringes on other companies’, applicants’ or third parties’ intellectual properties, portrait rights, privacy rights, honor, other rights or properties in order to run the service (c) against public order and morality, or related to a criminal act such as a pyramid scheme, scam, chain referral or other business which could be a socially detrimental matter, (d) against ordinances or our internal rules or rules of industry groups you belong, (e) may disrupt the service's operation, (f) having a purpose other than hiring, (f) including false or inaccurate information or using hyperbole, (g) indicating a wage less than the minimum wage settled in the Minimum Wage Law (最低賃金法), (h) not indicating conditions of employment determined by the Labor Standard Act (労働基準法), to need to be clearly specified at the point of concluding a contract of employment, (j) including expressions which may confuse applicants or cause misunderstandings, (k) including discriminatory statements, (l) including any terms which shift costs to the applicants, (m) Business activities fall within the Sex Industry Law (風俗営業等の規制および義務の適正化等に関する法律) or sex-related services, (n) Organizations supporting organized violence, antisocial activities or antisocial forces, (o) dating sites, sexually explicit sites or live-chatting sites, (p) Unlicensed businesses operating in fields which require a license or governmental approval, (q) Infringing upon any of these terms, or (r) any other occasion where we determine posting is improper.

6. You are solely responsible for making and sending job advertisements, and will settle any disputes between third parties regarding to a job advertisement on your own responsibility. Both Publishers and Joblet are not responsible for damages and disputes arising from a job advertisement between job posting companies, applicants and third parties.

4 Suspension of Posting

1. We can suspend a job posting temporarily or perpetually when a job advertisement falls under the conditions listed in Section 5, Paragraph 3, when we determine a job advertisement is inappropriate, or when we determine we need to do so.

2. We are not responsible for any damages incurred from this action, and the company remains obligated to pay compensation stated in Paragraph 5.

5 Fee and Rejection System

1. You pay us defined fee and equivalent amount in a tax per applicant you receive through job posting based on Paragraph 3, except as otherwise stated in Section 2, below.

2. You can reject applicants who you do not wish to interview. We don’t invoice you for rejected applications.

6 Payment

1. We calculate the fee in the end of every month and invoice accordingly. Payments are due by 10th of the month after the following month and you must pay us by a means which we specify. You will bear bank transfer fees and other needed expenses for payment.

2. This fee stated in the previous term won’t be dissolved, resolved or absolved for the suspension stated in Paragraph 4 or any reason.

3. If you fail to make any payment, you shall pay to us an 18.5% annum of unpaid amount as delayed damages together with principal from the date payment becomes due until the date payment is made.

7 Limits of Joblet’s Responsibilities

1. We are not responsible for any damages you might incur from applying to Joblet service or using Joblet service.

2. We are not responsible for problems by caused by any extraordinary event or circumstance beyond our control such as viruses, hardware or software failure, or any other such force majeure.

3. We cannot ensure the accuracy of information provided about or by third parties such as job posting companies, contents of job advertisements or other information provided by job posting companies or any third parties on Joblet.

4. We cannot ensure that there are not any errors or other flaws on the Joblet web site, there are not any virus or other harmful factors in servers, or the system or infrastructure for offering the service are free from defect.

5. We are not responsible for available information through any links to the Joblet service from any other web sites or links from other web sites to the Joblet web site.

8 Dispute Settlement and Payment of Damages

1. If you inflict damages on us by violating Joblet Terms of Use or any relevant misuse of the service, you shall respond in damages.

2. If you receive a claim from other job posting companies, applicants or third parties relevant to the service, or if disputes occur among them, you shall give us notice and settle the claim or dispute at your own responsibility and expense, and report to us the results if requested.

3. If we receive any demand from other job posting companies or third parties regarding the infringement of rights or other matters relevant to your use of the service, you must indemnify us for any expenses paid to that party based on the demand.

4. If you incur losses on account of reason attributable to our failure, we are responsible for only an actual customary loss as a direct consequence. Our indemnity liability is, however, limited to the fee we actually have received from you.

9 Protection of Confidentiality

1. Both parties use all information (except the public domain) relating to the other's techniques, sales, business, finance and organizations furnished by the other or any confidential information we may obtain regarding to Joblet Terms of Use or the Joblet service only for the purpose of Joblet.

2. Both parties shall not disclose confidential information to any third party unless approved mutually by both parties in a written format.
